General terms and conditions
Article 1.
The legal relationship between Marie-Bénédicte Jewellery Design, (hereinafter referred to as "Marie-Bénédicte de Schryver"), established in 9000 Ghent, Eekhout 16, Belgium, registered in the CBE under the number 0589 872 044, and the Customer, is governed by these General Terms and Conditions, the order form, the invoices and any special conditions (hereinafter collectively referred to as "the Agreement"). Article 2.
These Terms and Conditions cover any sale, any reworking of existing materials or jewellery of the customer and the repair of jewellery. The agreement comes into effect:
- In case of payment by the buyer of a jewel via the online shop
- In case of acceptance by Marie-Bénédicte de Schryver of the order placed by the customer, requested special order or requested repair
The General Terms and Conditions apply as soon as the Customer places an order, requests a special order or repair. By doing so, the Customer expressly acknowledges having read these conditions and accepts them in their entirety and without reservation. Although Marie-Bénédicte de Schryver makes every effort to present the entries on the website correctly, exceptionally certain data may contain errors. If a mention on the website contains an obvious error, Marie-Bénédicte de Schryver reserves the right to cancel any orders based on this obvious error.
Article 3.
All prices stated are expressed in EURO and always include V.A.T. All prices in the web shop include V.A.T. The prices stated on the website and in the online shop are valid at the time of publication on the site, these prices are subject to price fluctuations due to price fluctuations in precious metals and stones. The indication of price refers exclusively to the articles as described verbatim. The accompanying photos are a good indication, but may contain elements not included in the price. Prices for an order, special order or rework and repair include 21% VAT. For an order, from the time of acceptance of the quotation, 50% of the price to be invoiced is paid in advance by bank transfer. The balance of the price is due before the Client comes to collect the creation and without which no collection can take place. All payments are made by bank transfer or credit card. All payments must be made in advance. When purchasing via the webshop, delivery costs are charged separately.
Article 4.
Without prejudice to the exercise of other rights available to Marie-Bénédicte de Schryver, in the event of non-payment or late payment, the Customer shall be liable, ipso jure and without notice of default, to pay interest of 10% per year on the unpaid amount. In addition, the Customer shall be liable, ipso jure and without notice, to pay a fixed indemnity of 10% on the amount concerned, with a minimum of €25 per invoice. Without prejudice to the foregoing, Marie-Bénédicte de Schryver reserves the right to reclaim the articles not (fully) paid for. The delivered articles remain the exclusive property of Marie-Bénédicte de Schryver until the moment of full payment by the Customer.
Article 5.
For special orders following reworking of existing materials and/or jewellery that the Customer leaves in the care of Marie-Bénédicte de Schryver with a view to carrying out the order/reworking/repair, this jewel/material will be described. The abandonment by the customer of an existing jewel/precious stone/material cannot be regarded as an instalment.
Article 6.
Delivery of the order can take place up to 4 to 12 weeks after payment. The Customer shall collect the order from Marie-Bénédicte de Schryver, unless otherwise agreed. When ordering jewellery, the risk of loss, theft or damage during transport lies exclusively with the Customer, unless expressly agreed otherwise.
Jewellery ordered in the webshop that is in stock will be shipped within two working days to a maximum of three weeks.
Article 7.
Right of withdrawal: only the jewels purchased through the webshop (so no tailor-made jewels or jewels adapted according to the Customer's wishes, wedding rings and engagement rings) can be returned within 14 days. No later than 14 days after Marie-Bénédicte de Schryver has been informed of your decision, Marie-Bénédicte de Schryver will refund the price paid including delivery costs (with the exception of any additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us) using the same means of payment with which you paid. If the jewellery being returned is damaged, compensation will be claimed to offset the decrease in value suffered by the jewellery due to the damage.
Article 8.
Upon purchase of a handmade jewel from Marie-Bénédicte de Schryver, the customer is entitled to a two-year guarantee. This guarantee is only valid when the damage occurred as a result of hidden defects or construction faults in the product concerned. The repair or exchange of the product is therefore at the expense of Marie-Bénédicte de Schryver. The (commercial and/or legal) guarantee never applies to defects that arise as a result of accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, adjustments or modifications to the article, heavy-handed use, poor maintenance, or any other abnormal or incorrect use. In this case, the repair, if required, will be charged to the customer.
To invoke the warranty, the Customer must be able to provide proof of purchase. Customers are advised to keep the original packaging of the goods.
If a defect is detected, the Customer must inform Marie-Bénédicte de Schryver as soon as possible. In any event, any defect must be reported within 2 months after its discovery. Thereafter, any right to repair and/or replacement expires.
Article 9.
Any complaint must be reported within 14 days from the delivery date, via registered letter with accompanying photos of the jewel.
Article 10.
In case of disputes, only the courts of the judicial district of Ghent have jurisdiction.
In case of disputes, consumers can contact the Online Dispute Resolution platform. This is an internet platform created by the European Commission with the aim of resolving disputes arising from e-commerce out of court. https://ec.europa.eu/consumers/odr/main/?event=main.home2.show
